it is shown by the homage that Hen Wright out of court and after the last court surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Thos Harvye and Jn Hodson two customary tenants the same testifying according to the custom of the said manor one parcel of land sometime of a waste field of the lord of this manor lying in Earls Colne between the kings highway leading from the said Earls Colne towards Coggeshall on the east part and the lands called Colne Park on the west part containing in length from the rest of the land of the said Hen towards the south and upon a parcel of a waste field of the lord of this manor now enclosed towards the north about 6rod as it is now delimited or settled with stakes to the use and behoof of Edw Layer blacksmith and his heirs forever upon the condition that neither himself nor his heirs or assigns should build upon it which same said parcel of land should be enclosed and maintained by the aforesaid Edw and his heirs against the said lands of the same Hen and likewise the aforesaid Edw and his heirs should owe in payment to the lord of the same manor and his heirs for the aforesaid lands annually the sum or rent of 1d provided always that if the said Edw or his heirs should not pay or cause to be paid to the aforesaid Hen Wright his heirs executors or assigns the sum of 11s on or before 5.8.1623 after the date of this surrender in or at the dwelling house now of the said Hen in the said Earls Colne that then this present surrender should be void but if the aforesaid sum is paid the surrender to remain in full force and effect
