it is also shown that before this court and after the last court Jn Hatch and Sam Burton surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Edw Potter and Barth Clarke two customary tenants the same testifying according to the custom of the said manor the east end of one customary tenement called Masons containing in length 37ft viz as far as a hall with stable yard and garden lying on the north side and the east end of the same said tenement being a parcel of one messuage with appurtenances called Masons lying between the churchyard of Earls Colne and the kings highway leading from the said Colne towards Halstead on the north part which same said premises the said Jn Hatch took for himself and his heirs at a court here held tuesday being 18.9.1604 and all right title claim and demand whatsoever of the aforesaid Jn Hatch and Sam Burton and either of them of and in the said premises to the use and behoof of Jn Pennocke of Colne baker his heirs and assigns to whom the same said Jn Pennocke present here in court the lord by his said steward granted and delivered seisin thereof by the rod to have for himself and his heirs forever to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents customs and services thereunto belonging and by right accustomed and he made fine and fealty to the lord and was admitted etc and afterwards at this same court the same court sitting Jn Pennocke in person surrendered into the hands of the lord by the hands of the aforesaid steward the said premises with appurtenances with this intention that the lord at this same said court should be pleased to regrant to himself the same said Jn Pennocke for the term of his natural life the remainder thereof after his decease to Wm Pennocke his son and heir of the aforesaid Jn his heirs and assigns forever to whom the same said Jn and Wm the lord by his said steward granted and delivered seisin thereof by the rod to have to himself the aforesaid Jn Pennocke for his lifetime the remainder after his decease to the said Wm his son and his heirs and assigns forever to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents customs and services thereunto belonging and by right accustomed and the aforesaid Jn Pennock and the aforesaid Wm in remainder made fine and fealty to the lord and were admitted tenants thereof
