whereas at a court here held for the said manor 20.10.1625 it was shown by the homage of this court that Sam Tryon knight bt and Robt Sache out of court viz on 17.4.1625 surrendered into the hands of the lord by the hands of Rich Kempe and Robt Rookes two customary tenants in the presence of Robt Walker instead of the bailiff and according to the custom of the said manor all that his messuage or customary tenement and 9a of land or thereabouts with appurtenances pertaining to the said tenement lying in the said Earls Colne at that time in the occupation of Thos Stoke or his assigns to the use and behoof of Ann Coggeshal widow her heirs and as signs upon condition that if the aforesaid Robt Sache his heirs executors or assigns should pay or cause to be paid to the aforesaid Ann Coggeshal her heirs executors or assigns the sum of 60li at the day then to come and now past then the same surrender should be void now it is shown by the homage of this present court that the said Robt Sache by his proper confession in full court did not pay the said sum of 40li nor any penny thereof according to the condition of the said surrender upon which now to this court came the aforesaid Ann Coggeshal in person and humbly sought absolute admittance to the said messuage and other premises according to the tenor and intention of the said surrender to whom the same said Ann at her petition the lord by his said steward granted and delivered thereof seisin by the rod to have for herself and her heirs absolutely without any condition to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents customs and services thereunto belonging and by right accustomed and she made therefore fine and fealty to the lord and was admitted etc and afterwards on the same day to this present court came the aforesaid Robt Sache in person and acknowledged himself to have received and to have had from the aforesaid Ann Coggeshal the sum of 40li above the said sum of 60li mentioned in the condition in full payment and satisfaction for the messuage and other premises and in consideration thereof the same said Robt Sache now surrendered into the hands of the lord the messuage and other the said premises to the use and behoof of the aforesaid Ann Coggeshal her heirs and assigns forever and furthermore in the said consideration by himself and his heirs he released remitted and quitclaimed to the aforesaid Ann in her full and peaceful possession and existing seisin to her heirs and assigns forever all right title claim and demand whatsoever of or in the premises or in any parcel thereof thus etc
