whereas at a view with court here held for the said manor 17.5.1630 Clem Turnor and Edith his wife were admitted tenants of the lord for themselves and the heirs of the said Clem to one tenement or cottage sometime called Humfries by the surrender of Thos Prior junior as by a roll of the said court clearly shown now at this court it is shown by the homage that the said Clem Turner after the said court and before this court viz 19.5.1630 surrendered into the hands of the lord by the hands of Geo Sympson instead of the bailiff in the presence of Jn Church gentleman and Wm Addams two customary tenants of the said manor the same testifying according to the custom of the said manor all that cottage messuage or said tenement sometime called Humfrys to the use and behoof of Mary Nevill of Pedmarsh widow and her heirs forever upon the condition that if the said Clem Turnor his heirs executors or administrators should satisfactorily fulfil and pay the said Mary Nevill her heirs executors or administrators 12li9s6d on or before 27.10.next following the said surrender at the dwelling house of the said Geo Simpson in Pedmarsh that then the said surrender should be void and of no force and furthermore it is shown by the said homage that the said Clem Turnor did not pay fulfil and satisfy the said Mary Nevill of the said 12li9s6d according to the condition contained in the said surrender upon which came here into court the said Mary Nevill and humbly sought admittance to the premises to whom the lord by the said steward granted and delivered seisin thereof by the rod to have the said cottage messuage or tenement with appurtenances to the said Mary Nevill and her heirs forever in fulfilment of the said conditions to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord her fine and made fealty to the lord and was admitted thereof tenant
