to this court came Thos Prior and Mary his wife who held to themselves and the heirs of the said Mary and in the right of Mary herself one messuage or customary cottage with appurtenances called Cloviers as is shown by the court roll dated 23.4.1622 and Mary herself solely and secretly examined by the steward of the court as is the custom surrendered into the hands of the lord by the hands of the said steward the said messuage or cottage with garden with all and singular their appurtenances to the use and behoof of Jn Furley of Colchester senior gentleman his heirs and assigns forever upon condition that if the said Thos Prior and Mary his wife or any of them their or any of their heirs executors administrators or assigns shall pay or cause to be paid to the said Jn Furley his executors or assigns the sum of 40li in or on 30.12.1641 in or at the mansion house of the said Jn Furley in Colchester that then the said surrender will be null and void
