at this court it was presented by the homage that Wm Wiborow and Ann his wife customary tenants of the said manor in right of the said Ann did come before Jn Joscelyne esq steward of the said manor and the said Ann being solely and secretly examined by the said steward and consenting did according to the custom of the said manor surrender into the hands of the lord of the said manor by the hands of the said steward three crofts of land called Petticrofts alias Pettcrofts with the appurtenances to the use of such person and persons and for such estate and estates and in such manner and form as Wm Harlakenden of Earls Colne esq shall nominate and appoint and until such nomination and appointment to the use of the said Wm Harlakenden his heirs and assigns upon condition that if the said Wm Wiborow and Ann or either of them their or either of their heirs executors or administrators shall and do well and truly pay or cause to be paid to the said Wm Harlakenden his executors or administrators at or in the dwelling house of the said Wm Harlakenden in Earls Colne aforesaid 38li1s6d of lawful money of England in manner following that is to say 40s9d thereof upon 22.6.1653 and 36li9d residue of the said 38li1s6d upon 23.6.1654 that then the said surrender to be void
