whereas at a court held for the said manor 18.4.1650 Wm Death was admitted tenant to him and his heirs to seven crofts of customary land called Michells containing 30a more or less and whereas at a court held for the said manor 1.11.1653 it was presented by the homage that the said Wm Death since the last court that is to say upon 26.1.last did surrender into the hands of the lord of the lord of the said manor by the hands of Nich Hurrell in place of the lord's bailiff and in the presence of Edw Elliston gentleman and Hen Abbott two customary tenants of the said manor the same witnessing the said premises to the use of his last will and testament and afterwards died so seised and because none came after proclamation thrice made to be admitted tenant to the said premises a precept was made to seize the lands into the lord's hands etc now at this court Eliz Death widow the late wife of the said Wm and Jn Death the youngest son of the said Wm did come and show forth in court the last will and testament of the said Wm Death in writing bearing the date 26.1.1653 the tenor whereof was concerning the premises in these words item I give to Eliz my wife all those my seven closes of customary land called Michell holden of the manor of Earls Colne with a barn thereunto belonging to have and to hold the said customary lands and premises to the said Eliz for and during the term of her natural life item I give and bequeath to Jn Death my youngest son the reversion and remainder of all those my seven closes of land called Michells with a barn thereunto belonging to have and to hold the said seven closes of customary land to the said Jn Death from and after the decease of the said Eliz my wife and to his heirs forever item my will and pleasure is that if either of my two sons shall depart this life before he shall have attained his age of twenty one years whereby his portion of land hereby bequeathed may or shall descend to the other son surviving then the said son surviving shall pay to my daughter Eliz her heirs or assigns the sum of 30li within three years next after the decease of the said Eliz my wife and in case all my said three children shall depart this life before they or any of them shall have attained their general ages of twenty one years having no issue of their or any of their bodies lawfully begotten then I will and bequeath all those my seven closes of land called Michells with the barn thereunto belonging to the said Eliz my wife and her heirs forever as by the said last will relation being thereunto had it doth and may more at large appear and thereupon the said Eliz Death late wife of the said Wm and Jn Death desired to be admitted tenants of the said premises to whom the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said seven closes of land and barn to the said Eliz for the term of her life and after her decease to have and to hold the same to the said Jn Death and his heirs according to the said will of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due and they gave to the lord their fines and the said Eliz did her fealty
