at this court Edw Hewson gentleman and Eliz his wife daughter and heir of Jn Lucas gentleman and Mary his wife both deceased came and the said Eliz first by the said steward solely and secretly examined as is the custom and consenting the said Edw and Eliz by the rod surrendered into the hands of the lord by the hands of his said steward one croft of land called Wallnut Tree Croft with appurtenances which said croft with appurtenances the said Eliz after first having the recovery thereof among others at this court took for herself and her heirs to the use and behoof of Rose Abbott elder daughter of Hen Abbott of Earls Colne saymaker and the heirs and assigns of the said Rose forever upon the trust and confidence however that if the said Hen should survive Rose his now wife and the mother of the said Rose and if the said Rose wife of the said Hen should die without heirs of her body by the said Hen procreated that the remaining heirs of the said Rose the daughter should surrender the said croft with appurtenances to the use and behoof of the said Hen his heirs and assigns forever upon which came here into court the said Rose the daughter the said Hen in the part of attorney and deputy and sought admittance as tenant of the lord to the premises to whom the same said Rose the daughter by the hands of her said attorney and deputy the lord by the said steward granted and delivered seisin thereof by the rod to have and to hold the said croft with appurtenances to the said Rose the daughter her heirs and assigns upon the said trust and consideration of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord her fine and because the said Rose is under age viz 8yrs or thereabouts (sic) therefore the lord granted custody of the said tenements to the said Hen until the said Rose the daughter should reach her full age and by the said steward he delivered to him possession thereof by the rod to hold from the lord by the rod etc by the rents and services thereunto belonging and without wastage or stripping and to return to the said Rose the daughter an account of the rents and profits of the premises when she should reach her said age and for such custody the said Hen gave to the lord his fine
