whereas at a court here held 16.1.1655 Martha Gibson and Susanna Gibson daughters and coheirs of Grace Gibson deceased elder daughter of Ambrose Waller deceased and Rachel Greene wife of Hugh Greene other daughter of the said Ambrose were admitted tenants of the lord for themselves and their heirs in coparcenary as coheirs of the said Ambrose to one messuage or tenement and garden called Morses customary land and to one parcel of land or yard containing by estimation half a perch of land adjoining to the said messuage on the east and enclosed with fencing or pales and whereas at a court here held 2.4.1662 it was testified by the said steward and was shown by the homage that after the then last court viz 3.6.1661 the said Hugh Greene and Rachel his wife came before the said steward and the said Rachel solely and secretly examined by the said steward as is the custom and consenting the said Hugh and Rachel by the rod surrendered into the hands of the lord by the hands of his said steward one half and all part and purpart of theirs to the said messuage garden and parcel of land with appurtenances to the use and behoof of Jas Gibson son and heir of Jas Gibson late of Lexden miller deceased and the heirs and assigns of the said Jas Gibson the son forever upon the condition however that if the said Hugh and Rachel or either of them their heirs executors administrators or assigns or any of them should pay or cause to be paid to the said Jas Gibson the son his executors or assigns at or in the dwelling house of Mary Bircher widow situated in the said Lexden 3li of legal English money upon the 4.6.1662 and 53li of the agreed money upon 4.6.1663 that then the said surrender would be null and void in law now to this court came the said Jas Gibson the son by the said Mary Bircher his mother and in the part of his attorney and deputy and gave to the court here intelligence and information that the said sum of 3li and 53li or any part thereof was not paid according to the said conditions and that non payment continues to this time and upon this the said Jas Gibson the son by his said attorney and deputy humbly sought admittance as tenant of the premises to whom the same said Jas Gibson the son by the hands of his said attorney and deputy the lord by his said steward granted and delivered seisin thereof by the rod to have and to hold the said half of the said messuage garden and parcel of land or yard with appurtenances to the said Jas his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord his fine but his fealty was respited
