whereas at a court here held 2.4.1662 Jn Scott and Mary his wife were admitted for themselves and the heirs of the said Jn to three crofts of land called Peticrofts also Pettscrofts with appurtenances containing by estimation 4a now at this court it was testified by the said steward and was shown by the homage that after the last general court viz 19.1.1663 the said Jn Scott and Mary came before the said steward and Mary herself solely and secretly examined by the said steward as is the custom and consenting the said Jn Scott and Mary by the rod surrendered into the hands of the lord by the hands of the said steward the said three crofts of land with appurtenances to the use and behoof of Geo Cressner of Earls Colne gentleman his heirs and assigns forever upon the condition however that if the said Jn Scott and Mary or either of them their heirs executors or assigns or any of them pay or cause to be paid to the said to the said Geo his executors or assigns at or in the then dwelling house of the said Geo situated in the said Earls Colne the sum of 26li of legal English money upon 29.9.1663 that then the surrender should be null etc upon which came into court the said Geo Cressner and gave to the court here intelligence and information that the said sum of 26li or any part of it was not paid according to the conditions in the said surrender and afterwards in judgement for the said Geo on the avoiding of the payment of the legal sum of English money by the said Jn the said Jn illegible text bearing the date 27.1.1664 for himself and his heirs remised released and quitclaimed to the said Geo Cressner and his heirs the said condition and power to retake the said premises and all title estate interest and demand of Jn himself in and to the premises and to whatever premises thereof and illegible text and the said surrender was unmade the said conditions now standing according as it appeared by the said writing here in court and upon this the said Geo Cressner sought admittance as tenant of the lord for the premises to whom the lord by the said steward granted and delivered thereof seisin by the rod to have and to hold the said three crofts of land with appurtenances to the said Geo and his heirs and assigns forever free of the said conditions from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord his fine and made fealty
