at a court held 9.5.1710 Eliz Rogers was admitted to her and heirs to one cottage with appurtenances in Earls Colne then in occupation of Jn Bullock now at this court it appears to homage that 27.3.last said Eliz Rogers surrendered by rod into hand of the lord by hand of Sam Burton in place of the bailiff in presence of Gilb Smith and Jn Newton two customary tenants etc said cottage or tenement with appurtenances to use of her last will after which to this court came Isaac Potter churchwarden of Earls Colne and Wm Chapman overseer of the poor of Earls Colne and produced here in court last will of said Eliz Rogers dated 27.3. last past in following english words I give and bequeath all that my customary cottage or tenement with the yards orchards and backsides with the appurtenances to the same belonging as it is now standing lying and being in the parish of Earls Colne aforesaid and now in the tenure or occupation of her the said Eliz Rogers and Thos Rayner (may be Thos Rayner) or their assigns unto the churchwardens and overseers of the poor of Earls Colne aforesaid and to their successors for the time being towards the bringing up and maintenance of Mary Rogers alias Grimston my only daughter as by the said will plainly appears and thereupon the said Isaac Potter and Wm Chapman present here in court humbly petition etc the lords by deputy steward granted delivery of seisin by the rod to have and hold the said premises with appurtenances to Isaac Potter and Wm Chapman under security and intentions of the above mentioned will of the lords etc and gave fine etc
