at this court it was presented and appeared to the homage that Dan Bailey a customary tenant since last court died and that to wit 30.5.1719 he surrendered by rod into hand of lord by hand of Geo Barnard in place of the bailiff in presence of Robt Harris and Jn Pratt two customary tenants etc his customary messuages lands and hereditaments whatsoever held of said manor to such uses as would be declared in his last will in writing or made in a certain marriage contract and after into court came Hen Adams junior and produces in court a certain indenture bearing dates respectively 26.9.1719 and 27.9.1719 purporting to the marriage contract of said Hen Adams and Mary Clarke granddaughter of said Dan Bailey by which said Dan granted and declared amongst others all that messuage or tenement and barn with appurtenances situate in Earls Colne then in tenure of Esdras Paretree late estate of Simon Bailey to use of him Dan for his life and after his death to use of Hen Adams junior and Mary for their lives and after death of longer liver to such uses which are particularly mentioned in the indenture as by that appears and thereupon said Hen and Mary in their own persons petition etc admitted to premises
