at a court held 23.4.1731 Jos Abbutt gentleman a customary tenant of manor surrendered by rod into hand of lord by hand of steward all and singular his copyhold messuages lands and tenements held of the manor to use of his last will in writing and at this court homage present the death of Jos Abbutt whereupon comes into court Abigail wife of Oliver Johnson sister of Jos and produced will of Jos dated 9.11.last in which Jos Abbutt did amongst other lands and tenements therein devised give and devise unto his sister Abigail Johnson and her heirs all that messuage or tenement and farm called Curds Priestland or otherwise with all lands and appurtenances belonging and all his share and right of and in the same as they are situate in Earls Colne in the said county in tenure of Oliver Johnson or his under tenants subject to the payment of his late brother Edw Abbutt's legacies given to her children as by reference to will may appear said Abigail craves etc admitted tenant to premises to wit to two fifth parts the whole in five equal parts to be divided of 6a woodground parcel of Cogges Grove lying next land called Colne Park and also two parts of five of messuage or tenement with barns stables orchards and gardens to same belonging and 26a land and 3a1r meadow with their appurtenances called Curds and three crofts land called Barmanfields Rounsells and Pellsland containing by estimation 15a and also two parts in five of certain lands called Heathfield also Heath Croft Stonyland and Brookhouse Meadow lying in Earls Colne by estimation 20a and all their appurtenances which said two parts or shares said Jos Abbutt had on surrender of Francis Sibley and Dorothy his wife Thos Everett younger and Judith his wife which said Dorothy and Judith were two of the daughters of Isaac Elliston deceased and also the other fifth part the whole into five equal parts to be divided of all and every the messuages lands hereditaments and premises which said Jos Abbutt had on the surrender of Ruth Elliston and Eliz Elliston two of the daughters of the said Isaac Elliston deceased etc according to will of brother etc
