whereupon comes into court Rich Wale and personally demands against Geo the said tenement etc as his right and inheritance which Geo has not any entry but after the disseisin which Hugh Hunt unjustly and without judgement has made to the said Rich within thirty years etc whereupon he declared he was seised etc in his demesne as of fee etc and thereof brings suit Geo in proper person comes and defends etc calls to warranty said Jn Middleton who is personally present etc and freely warrants said tenement to Geo Rich demands against Jn etc Jn etc defends right etc and further calls to warranty Jn Paine who is present and freely warrants said tenement to Jn Middleton etc whereupon Rich demands against him said Jn Paine etc says that he was seised etc Jn Paine etc says that Hugh Hunt did not disseise Rich etc as writ and declaration above does suppose and of this he puts himself etc Rich prays leave to imparl until six of the clock in the afternoon of the same day and he has it and afterwards etc Rich comes again etc but said Jn Paine although solemnly summoned comes not again but departed in contempt of court and made default therefore it is judged that Rich do recover etc against Geo and Geo do recover of the lands of Jn Middleton to the value etc Jn do recover of the lands of Jn Paine to the value etc Jn Paine amerced etc Rich prays precept etc Isaac Potter officer of the court and bailiff now returns by virtue of precept etc full seisin etc to Rich Rich craves to be admitted tenant to premises lords by steward granted seisin etc
