fine 2s condition to this court came Wm Clerk and Jn Wrygth of Colfordhell of Earls Colne and surrendered into the hands of the lord one messuage with garden adjoining with appurtenances together with one gateway for going in and out of the aforesaid garden into Le Lowefeld whereof the aforesaid messuage with its garden pertaining lies between a messuage of Jn Payn corn loader on one part and a messuage of Jn Grene on the other part one head abutting upon the king's highway towards Colchester to the use of Wm Frauncys Jn Nytynggale Thos Lytylman and Jn Wayte upon this condition however that the aforesaid Wm Jn Thos and Jn or their attorneys should pay or cause to be paid to the aforesaid Wm Clerk and Margt his wife and Thos Kelet or their attorneys 10marks sterling viz at the feast of michaelmas.next 26s8d sterling and at the feast of michaelmas then next following 26s8d sterling and thus from year to year until the aforesaid 10marks sterling should be paid to whom the lord now at court granted thereof seisin to hold to the same said Wm Jn Thos and Jn their heirs and assigns from the lord at the will of the lord by the ancient services and customs etc and upon the aforesaid condition etc and if it should happen that the aforesaid Wm Jn Thos and Jn or their attorneys should default in the aforesaid payment at any of the aforesaid terms in part or in whole then truly it should be allowed to the aforesaid Wm Clerke and Margt his wife and Thos Kelet or their attorneys to go into and reenter the aforesaid messuage with its appurtenances and to retain it notwithstanding this surrender otherwise it should stand in its force and vigour and if the aforesaid Wm Frauncys should wish to buy a better messuage with its appurtenances for his pleasure and profit during the term of purchase then truly it should be allowed to the aforesaid Wm Fraunces and his feofees to sell the aforesaid messuage with appurtenances which was lately of Wm Clerke at a better price to pay for the other messuage with its appurtenances which he would buy to his profit and the aforesaid feofees thereof should hold the jointly purchased fees in the same said messuage with its appurtenances and the same said Wm Frauncys did not buy any other messuage with its appurtenances during the period of payment and after the decease of the said Wm Frauncys the aforesaid messauge with its appurtenances which was lately of the said Wm Clerke or any messuage with its appurtenances which he bought one of the same to remain to Margt wife of the said Wm Frauncys for her lifetime to hold to herself or her attorney for her lifetime from the lord at the will of the lord by the ancient services and customs etc and after the decease of the said Margt the aforesaid messuage with its appurtenances to remain to the rightful heirs between the said Wm Frauncys and Margt his wife legitimately procreated by their bodies and thus the heirs of the heirs of their bodies legitimately procreat ed to hold to the same said heirs from the lord at the will of the lord by the ancient services and customs etc and if it should happen that the aforesaid Wm Frauncys and Margt his wife should die without heirs of their bodies legitimately procreated and issuing that in the absence then truly the aforesaid messuage with appurtenances should remain to the aforesaid Jn Nytinggale Thos Lytylman and Jn Wayte their heirs and assigns upon this condition however that the same said Jn Thos and Jn their heirs or attorneys should sell the aforesaid messuage with its appurtenances by the lord's licence and with the money thereof issuing to pay their debts and to dispose of the rest for the good of their souls and in good and rightful works and in other works of charity viz cutting headstones for the church for poor men and women and ruined ways within the parish of Earls Colne to whom the lord thereof at this court granted thereof seisin to hold to the same said Jn Thos and Jn their heirs and attorneys upon the aforesaid condition from the lord at the will of the lord by the ancient services and customs etc and they gave to the lord for a fine etc and made fealty etc
