fine 12d and at this same court it was shown by the homage that Jn Ashford and Agnes his wife she herself by the steward solely and secretly examined surrendered into the hands of Jn Bukkere the lord's bailiff in the presence of Jn Smyth and Wm Hawk and other of the lord's tenants the same testifying according to the custom of the manor one messuage with curtilage adjoining with appurtenances lying between a messuage late of Robt Kyrton on one part one head thereof abutting upon the king's highway leading from Colne towards Halstead and the other upon The Tollehouse Grene to the use of Robt Clerk and Jn Smyth to whom the lord by his steward granted thereof seisin to hold to the same said Robt and Jn their heirs and assigns from the lord by the rod at the wi ll of the lord according to the custom of the manor by the services and customs etc saving the right etc and upon the condition that the aforesaid Robt Clerk should pay or cause to be paid to the aforesaid Jn Asheford and Agnes his wife either of them or their attorneys 5marks6s8d to be paid in this form four times a year after this present date 3s8d until the aforesaid 5marks6s8d sterling should be faithfully and fully paid and if there should be default in any payment at any of the quarter years in which there ought to be payment in part or in whole that then it should be allowed to the aforesaid Jn and Agnes because of default of payment to reenter thereinto and to rehold them the previous surrender made notwithstanding should be void and they gave to the lord for a fine etc as shown and made fealty to the lord etc
