at this court Jn Tostewood bailiff of this manor and minister of this court returned a certain precept to him directed at the last court between Thos Garrard the demandant and Jn Garrard the tenant served and executed in every behalf and hereupon the jurors impanelled being required appeared viz Robt Peerson Jn Barret Rich Ennowes Wm Bunner Robt Rookes Thos Bridge Hen Smythe Thos Allen Jn Leffingwell Robt Reade Rich Prentice and Jn Ward who being sworn and charged upon their oath to know if Jn Garrard the father of the foresaid Thos Garrard were seised in his demesne as of fee to the will of the lord according to the custom of the manor of and in one messuage 12a of land 4a of meadow and 10a of pasture of the customary lands of this manor with the appurtenances and if the same Jn Gerrard the father died within fifty years now last past and if the foresaid Thos Gerrard be the son and next heir of the foresaid Jn the father say upon their oath that the foresaid Jn Gerrard the father was seised in his demesne as of fee accor ding to the custom of the manor at the day of his death of and in one customary messuage and 12a of land 4a of meadow and 10a of pasture of the customary lands of this manor with the appurtenances and that the same Jn died within these fifty years now last past and that the said Thos Gerrard is the next heir of the said Jn whereupon now came the foresaid Thos Gerrard and humbly prayed to be admitted to the premises as to his right and inheritance to whom because it is so found by the homage there is seisin thereof delivered by the rod to hold to him his heirs and assigns of the lord by the rod etc
