fine 4li | it is found by the homage that Jn Barret that held to him and his heirs of the lord by the rod etc one messuage with a garden adjoining with appurtenances called Sonnells as etc as by copy of court roll here holden 21.6.10Eliz1 more at large appears died since the last court and before his death lying on his death bed surrendered into the lord's hands by the hands of Jn Churche instead of the bailiff and in the presence of Barth Churche and Thos Leffingwell the lord's customary tenants and other the same witnessing the foresaid messuage and garden with appurtenances amongst other things to the use and behoof and for the performance of his last will and testament by which he gave wi lled and legacied the premises amongst other things in these english words following viz item I give and bequeath unto Margery my wife all that my customary messuage or tenement wherein I now dwell with all the houses buildings edifices yards orchards gardens lands meadows and pastures to the same belonging and all other my customary lands meadows and pastures now in mine own occupation or manurance situate and lying in Earls Colne aforesaid all which I now hold by copy of court roll of the right honourable earl of Oxford as of his manor of the earldom and Priory and of either of them to have and to hold the said messuage or tenement lands and other the premises with the appurtenances unto the said Margery my wife during and until Jn my son shall come unto his age of twenty one years and then at the said age of twenty one years of Jn my son I will that all the said messuages tenements lands and all other the premises with appurtenances shall remain unto the said Jn my son and his heirs forever according to the custom of the manor and if it shall happen the said Jn my son to depart this world before his age having no issue of his body lawfully begotten then I will the said Margery my wife shall likewise have and hold the said messuage lands and all other the premises with the appurtenances during until my two daughters Agnes and Mary shall accomplish their several ages of twenty one years and then I will all the said messuages lands and all other the premises shall remain and come unto my said two daughters Agnes and Mary and their heirs forever according to the customs of the said manor equally to be divided as by the said will bearing date 23.8.1582 approved and here shown to the court more fully appears whereupon now came the foresaid Margery the widow of the said Jn Barret and humbly prayed to be admitted to the foresaid messuage being parcel of the premises according to the force form and effect of the surrender aforesaid to whom by the lord's steward there is seisin thereof delivered by the rod to have and to hold to the said Margery in the form aforesaid of the lord by the rod etc |
