it is found by the homage of this court that Robt Partridge of Finborrow in the county of Suffolk out of this court and since the last court viz 28.10.1589 etc surrendered into the lord's hands by the hands of Wm Loveney instead of the bailiff in the presence of Jn Greene and Thos Smythe customary tenants of this manor the same witnessing according to the custom of the manor one messuage 26a of land 3a of pasture and 1r of meadow called Curdes with appurtenances in Earls Colne as by meets and bounds etc and also three crofts of land called Barmansfield Rounces and Pelles with appurtenances in Earls Colne aforesaid as by meets and bounds etc late of Geof Cuckoke and since of Rose his wife now the wife of the said Robt whereunto he was admitted the lord's tenant at the last court of this manor here holden the 18.9.1589 by the name of all his customary lands and tenements then in the occupation of Wm Loveney to the use and behoof of Edw Gourlinge and Jn Salter and of their heirs on condition that if the said Robt Partridge his heirs executors or assigns or any of them pay or cause to be paid to the said Edw Gourlinge and Jn Salter their heirs executors or assigns the whole sum of 138li of good and lawful money etc upon the 20.10.1590 etc without any fraud or further delay that then and from thence the foresaid surrender made in form aforesaid shall be void and of no force in law otherwise it shall remain in full force and effect and hereupon the same Edw and Jn being solemnly required to take the premises with appurtenances out of the lord's hands to them and their heirs according to the tenor of the said surrender and to pay the lord a fine of 30li taxed on them although they had warning of this court came not therefore the bailiff is charged to seize all the foresaid lands and tenements into the lord's hands upon the occasion aforesaid and to answer the lord the issues thereof taxed at 17li until etc
