in the name of god amen the 18.1.1626 etc. I Rich Hayward of Hedingham Sible in the county of Essex yeoman being sick in body but of sound and perfect mind and memory all glory be to almighty god do ordain make and declare this my last will and testament in manner and form following first and principally I commit and commend my soul into the hands and tuition# of almighty god my creator and to jesus christ my redeemer in whom and by whose merits I steadfastly hope and believe to be saved item I give and bequeath unto the poor people of Hedingham Syble aforesaid the sum of 20s to be distributed amongst them within one month next after my decease at the discretion of my executor hereafter named item I give and bequeath unto Ann Hayward my wife yearly during her natural life in lieu and full satisfaction of her third dower and other maintenance the sum of 10li of lawful money of England to be paid unto her the said Ann or her assigns half yearly next after my decease by even and equal portions by my executor hereafter named and if it shall happen the said yearly rent to 10li or any part thereof to be behind and unpaid after any the said times in which the same ought to be paid as aforesaid and not paid by the space of six days being lawfully demanded at my now dwelling that then and from thenceforth it shall and may be lawful to and for the said Ann my wife and her mark Rich Hayward assigns into all my freehold lands and tenement and hereditaments whatsoever which I now have in Hedingham Sible aforesaid or elsewhere in the said county of Essex with all and singular their appurtenances and into every part and parcel thereof to enter and distrain and the distress and distresses then and there found lawfully to take hold drive and carry away and impound and the same within pound to distrain and withhold for and until such time as the said Ann my wife of the said yearly rent of 10li in manner and form aforesaid to be paid and arrearages thereof if any be unto the said Ann my wife or her assigns fully satisfied contented and paid by my said executor hereafter named or otherwise item I give and bequeath and my will and mind is that the said Ann my wife shall have and enjoy all such goods and chattels and movables as were given and bequeathed unto her by the last will and testament of the said Ann Nicholson plainly appeareth to be delivered unto the said Ann my wife by my executor hereafter named within one month next after my decease and also all such other goods and chattels that she came well prove as did befall and come unto her for her part by and after the decease of the said Ann Nicholson her late mother likewise to be delivered unto her by my said executor hereafter named within one month next after my decease item I further give and bequeath unto the said Ann my wife her usual hutch or chest and one box with all her wearing clothes and linen in them and one warming pan and iron chafing dish two pairs of sheets one pillow and pillowbere likewise to be delivered unto her within one mark Rich Hayward month next after my decease by my executor hereafter named item I bequeath unto Barth Hayward my only son all that my lands tenements and hereditaments houses edifices and buildings whatsoever both free and copy in Hedingham Sible aforesaid or elsewhere in the said county of Essex and every part and parcel thereof with their and every of their appurtenances to have and to hold all the said lands tenements hereditaments houses edifices and buildings with all and singular their appurtenances unto the said Barth my son his heirs and assigns forever to the only proper use and behoof of the said Barth his heirs and assigns for evermore item I give and bequeath unto Eliz Hayward my sister one trundle bedstead and flockbed one flock bolster two blankets one coverlet one pillow one pillowbere one pair of sheets and her spinning wheel one joined stool which she usually sat on to be delivered unto her within one month next after my decease by my executor hereafter named item I give and bequeath unto Joseph Waters my kinsman the sum of 10s of lawful money of England to be paid unto him within one year next after my decease by my executor hereafter named item I give and bequeath unto Margt Maners my maid the sum of 10s of lawful money of England to be paid unto her within one year next after my decease by my executor hereafter named item further I give and my will and mind is that the said Ann my wife shall have all those my three sheep now grooming or being upon my grounds to be delivered unto her immediately after my death by my executor hereafter named provided always that if the said mark Rich Hayward Ann my wife shall at any time hereafter molest or trouble my executor hereafter named for any dower third or other maintenance then I have already by this my will given unto her then my will is that all such legacies and maintenance as I have already given and devised unto her shall be frustrate void and of none effect to all intents and purposes any thing in this my present will contained to the contrary in any wise notwithstanding all other my goods chattels and implements whatsoever unbequeathed my debts and legacies paid and funeral charges discharged I wholly and absolutely give unto the said Barth Hayward my son whom I do ordain name and make sole executor of this my last will and testament in witness whereof I the said Rich Hayward have hereunto set my hands and seal the day and year first above written sealed and delivered in the presence of (names of the
