in the name of god amen the 25.11.1639 etc. I Thos Gips of Earls Colne in the county of Essex and diocese of London yeoman being sick and weak in body but in good and perfect mind and remembrance I do give god thanks therefore I do make ordain and declare this my present last will and testament in manner and form following and I do hereby utterly renounce and revoke all former will or wills by me heretofore made whatsoever first and principally I commend my soul into the hands of almighty god the father the son and the holy ghost with and assured faith and steadfast hope to have the free pardon and forgiveness of all my sins and my body to the earth from whence it was taken to be decently buried in christian sepulchre according to my degree in sure and certain hope of salvation and blessedness amongst all the elect and holy saints of god in and through the only merit and passion of jesus christ my only saviour and redeemer and for that part and portion of worldly goods wherewith it hath pleased almighty god out of his free favour and love to endue me withal first I give and bequeath unto Jas Evered my brother in law the sum of 10li of good and lawful money of England to be paid unto him at two several payments viz that is to say the sum of 5li of lawful english money within one year next after my death and the other 5li within two years next after my death to be paid by my executrix item I give and bequeath unto Robt the son of Jas Evered my brother in law 40s of good and lawful money of England to be paid unto him within three years next after my decease by mine executrix and my will and meaning is that if it shall happen that the said Jas shall die before the expiration of the said term in which my said legacies of 10li ought to be paid as aforesaid that then I give the said 10li unto Marcy my sister his wife to be paid her or so much as shall be behind and unpaid at the time of the death of the said Jas as afore said item I give and bequeath unto Jas Evered my sister's son all my occupation at Cogshall which he hath in his custody already item I give and bequeath unto Jn Gray Wm Gray Annis Gray and Eliz Gray my sister's sons and daughters the sums of 5s apiece of good and lawful money of England to be paid to every one of them presently after the decease of Mary my now wife item I give and bequeath unto Mary Gips my brother's daughter the sum of 3li of lawful english money to be paid unto her presently after the decease of Mary my said wife item I give and bequeath unto Eliz Gips my brother Math's daughter my kinswoman the sum of 3li of lawful english money to be paid unto her presently after the decease of Mary my said wife item I give and bequeath unto Jn Cowell my kinsman and sister's son 40s of good and lawful money of England to be paid unto him presently after the decease of Mary my said wife item I give and bequeath unto Thos Rennolls my sister's son the sum of 40s of lawful english money to be paid unto him presently after the decease of Mary my said wife item I give and bequeath unto Mary Rennolls and Ann Rennolls my sister's daughters the sum of 40s apiece of lawful english money to be paid unto either of them presently after the decease of Mary my said wife item I give and bequeath unto Mary the wife of Hen Frost my sister the sum of 40s of good and lawful money of England to be paid unto her presently after the decease of Mary my said wife item I give and bequeath unto Jas Evered my brother in law all my wearing apparel to be delivered unto him presently after my decease excepting my wearing coat which I give and bequeath unto Evered Bull my servant to be delivered unto him presently after my decease and I do forgive unto him all the money which he oweth me all the rest of my goods whatsoever or wheresoever unbequeathed my debts and legacies being paid and my body decently buried I do give and bequeath unto Mary my said wife whom I do make and ordain to be my only sole executrix of this my last will and testament in witness whereof I have hereunto put my hand and seal the day month and year above written sealed acknowledged published declared and delivered as his last will and testament in the presence of us Jn Churche Wm Adams writer Thos Gips
