in the name of god amen I Rose Abbutt of Earls Colne in the county of Essex spinster being sick in body but of sound and perfect mind and understanding thanks be to god do make and ordain this my last will and testament in manner following hereby revoking all former wills by me made first and principally I humbly resign my soul into the hands of almighty god my most merciful creator hoping to be saved through the alone merits of jesus christ my most gracious redeemer and my body I desire may be decently interred in the parish church of Earls Colne aforesaid as near my late honoured father Hen Abbutt esq deceased as conveniently may be at the discretion of my executor and executrix hereinafter named and as to that worldly estate wherewith it hath pleased god to bless me I dispose thereof as followeth imprimis I give and bequeath unto my dear and honoured mother mrs Abigail Abbutt all those goods and household stuff which she now has in her possession which were given unto me by my said late father after her decease to dispose of as she shall think fit item I give and bequeath unto my youngest sister Joanna Abbutt and her heirs forever all that my messuage and farm called Monkdowns with all the lands and appurtenances thereunto belonging situate lying and being in Great Coggeshall in the said county of Essex or in any other parish or parishes thereunto near adjoining as the same now are in the tenure or occupation of Jn Newton the younger and Jn Patrick their or one of their assignee or assigns but my will and meaning is that my said sister Joanna or her heirs shall out of the said messuage farm and lands called Monkdowns pay and discharge a debt of 200li charged upon my portion of tithes in Great Coggeshall and Little Coggeshall and shall pay interest for the same until the same 200li shall be paid and also pay and discharge the sum of 500li more that is upon mortgage of the same farm and lands called Monkdowns in case the residue of my estate hereinafter mentioned be not sufficient and my will and meaning further is that in case my said sister Joanna shall happen to die without issue under the age of 21yr that my said messuage farm and lands called Monkdowns shall go to my brother Edw Abbutt and my sisters Abigail now the wife of Oliver Johnson Mary Abbutt and Grace Abbutt and their heirs forever and then I give and bequeath the same unto them the said Edw Abbutt Abigail Johnson Mary Abbutt and Grace Abbutt and their heirs accordingly item I give and bequeath unto my brother Hen Abbutt and his heirs forever all that my messuage or tenement and malting office with two crofts of land thereunto belonging with the appurtenances in Earls Colne aforesaid which were purchased by my said late father of and from Hen Adams he paying the sum of 100li item I give unto my said brother Hen Abbutt whatsoever monies he is anyways engaged to me by mortgage or otherwise upon condition that he gives unto my executors a general release of all accounts whatsoever except of the farm called Monkdown aforesaid but in case he does not then it shall be lawful for them to recover the same item I give and bequeath unto my executors hereinafter named all that my portion of tithes yearly arising renewing growing and coming out of and in the parishes of Great Coggeshall and Little Coggeshall in the said county of Essex and all my copyhold messuages lands and tenements holden of the manors of Earls Colne and Colne Priory and also all my freehold messuages lands and tenements situate lying and being in Earls Colne aforesaid and in Kersey in the county of Suffolk and all other my lands and tenements except what I have herein otherwise bequeathed unto my said brother Hen Abbutt and Joanna Abbutt and their heirs to be sold as soon as conveniently may be after my decease for the best price can be hand or gotten for the same and the monies arising by such sale and the rents and profits thereof until such sale I will shall be paid and disposed of for and towards the payment of the debt upon mortgage of the farm and lands called Monkdowns and for discharging of all my debts and legacies which my personal estate shall not be sufficient to discharge and the overplus monies arising by such sale and of my personal estate after my debts legacies and funeral charges shall be paid and discharged I give and bequeath unto my said sister Joanna Abbutt and her heirs forever item I give and bequeath unto my said sisters Abigail Johnson Mary Abbutt and Grace Abbutt the sum of 20li apiece to be paid by the said Joanna Abbutt out of the overplus monies or out of my said farm and lands called Monkdowns item I give and bequeath unto my said honoured mother Abigail Abbutt all my plate clothes goods and household stuff whatsoever now standing and being in the now dwelling house of Jn Newton the younger in White Colne to be disposed of at her discretion amongst my said three sisters and lastly I do nominate and appoint my said dear and honoured mother executrix and mr Jn Owers of Wickhambrook in the said county of Suffolk executor of this my last will and testament and I give unto him for his care pains and trouble therein the sum of 10li in witness whereof to this my last will and testament contained in two sheets of paper I have to each sheet set my hand and to the last sheet my seal this 3.12.1712 Rose Abbutt signed
