in the name of god amen I Edm Osborne of Earls Colne in the county of Essex yeoman being weak and infirm in body but of a sound and perfect mind and memory thanks be to god do make this my last will and testament in manner following hereby revoking all former wills by me made first and principally I commend my soul into the hands of almighty god my most merciful creator hoping to be saved through the alone merits of jesus christ my most gracious redeemer and my body I desire may be decently interred at the discretion of my executor herein after named and as to that worldly estate wherewith it hath pleased god to bless me I dispose thereof as followeth viz imprimis I give and devise unto my son Jn Osborne and to his heirs forever all that my messuage or tenement in Earls Colne aforesaid wherein I now dwell with all the lands tenements and hereditaments thereunto belonging holden of the manor of Colne Priory by copy of court roll with their and every of their appurtenances upon condition that my said son Jn Osborne his heirs or assigns shall and do pay unto my other children the several legacies hereinafter mentioned viz I give and bequeath unto my son Edw Osborne the sum of 10li to be laid out by my said son Jn Osborne or his heirs 20s a year in buying clothes or other necessaries for my said son Edw until the whole sum of 10li shall be laid out in case my said son Edw shall so long live item I give and bequeath unto my daughter Eliz the wife of Wm Mays the sum of 15li to be paid into her own proper hands by my said son Jn Osborne or his heirs 40s a year and 20s the last year until the whole sum of 15li shall be fully paid in case my said daughter Eliz shall so long live and I will that a receipt under my daughter Eliz's hand shall be from time to time a good discharge for the same and I will that the first payment to my said son Edw and to my said daughter Eliz shall be made within one year after my decease item I give and bequeath unto my youngest son Isaac Osborne the sum of 30li to be paid unto him by my said son Jn Osborne or his heirs within three years next after my decease item I give my daughter Mary Hales only 5s I having given her a portion already item I give unto my daughter Sarah Cooke only 5s I having given her a portion already item my will and meaning is that in case my said son Jn Osborne or his heirs shall and do refuse or neglect to pay unto my aforenamed children or any of them the several legacies herein before to them or any of them given or any part of them then and in such case it shall and may be lawful to and for such of my said children as shall be so unpaid contrary to this my will to enter into and upon my said messuage lands and tenements herein before given unto my said son Jn and his heirs and the same to have hold and enjoy and the rents issues and profits thereof to receive and take until the said legacies and every of them and all reasonable charges shall be fully satisfied and paid item my gift and devise of my said messuage lands and tenements unto my said son Jn Osborne and his heirs is upon this further condition that my said son Jn and his heirs shall and do permit and suffer my loving wife Margt Osborne to dwell and inhabit in my said messuage wherein I now dwell during the term of her natural life viz to have the use of the parlour of my said dwelling house wherein I now lie and the use of the room adjoining thereunto called the little parlour or old malthouse and also upon condition that my said son Jn Osborne or his heirs or assigns shall and do pay unto the said Margt my wife yearly and every year during the term of her natural life 8li of lawful money without any deduction to be paid quarterly on michaelmas day xmas day ladyday and midsummer day by equal portions the first payment to begin and to be made at which of the said four days shall first happen after my decease and upon this further condition that my said son Jn Osborne his heirs or assigns shall and do yearly and every year during the natural life of the said Margt my wife lay in and deliver unto her two loads of wood for her necessary firing to keep her warm in winter season item I give unto the said Margt my loving wife the use of the bed bedsteadle and bedding in the room wherein I now lie with the use of the goods and household stuff now in the same also the use of the great kettle one livery table six cloth chairs and leather chairs being in the chambers and also one oval table standing in the hall also the use of two flockbeds bedsteadles and bedding in the said room called the little parlour alias the malthouse and one chest also the use of my little kettle two pewter dishes and two pewter plates and of one beer vessel holding about mark Edm Osborne 20gall and of one half anchor vessel also the use of my kneading trough and of my brewing office and brewing vessels for and during the term of her natural life all the rest and residue of my goods chattels household stuff cattle corn stock and personal estate whatsoever and wheresoever after my debts legacies funeral charges and probate of this my will shall be fully satisfied paid and discharged I give and bequeath unto my said son Jn Osborne whom I nominate and appoint sole executor of this my last will and testament in witness whereof I the said Edm Osborne to this my last will and testament contained in two sheets of paper have to each sheet thereof set my hand and seal the 8.6.1730 etc. signed sealed published and declared by the testator in our presence and in his presence attested and
