this is the last will and testament of me Wm Bryant of Earls Colne in the county of Essex farmer as follows I appoint my son Jn Bryant and my friend Jn Overett of Great Tey in the said county farmer executors of this my will and I direct that all my just debts funeral and testamentary expenses shall be paid as soon as conveniently can be after my decease and my will and desire is that my farming business shall be carried on by my said executrix till the michaelmas day after my decease when I desire that all my furniture live and dead stock farming utensils and all movables shall be sold by auction and my farming business put off and everything I leave reduced to money I give and bequeath to my executors the sum of £100 in trust to pay or apply the same to or for the benefit of my son Wm Bryant according to their discretion in manner following (that is to say) not exceeding 6s weekly and every week till the whole sum shall be paid and applied provided always and I do hereby declare my mind and will to be that in case my said son Wm Bryant shall happen to die before the whole of the said sum of £100 shall be paid or applied there I do hereby give and bequeath all such part of the said sum of £100 then remaining unpaid to be applied by my executors in the maintenance clothing and bringing up the child or children of my said son Wm Bryant who shall be living at the time of my decease in such manner as my executors shall in their discretion think fit I direct my executors at the said michaelmas or as soon after as can be to invest in their names on such security as they shall think fit the sum of £200 and stand possessed thereof upon trust to pay the interest thereof half yearly to my son Jas Bryant and his assigns for his life for his own disposal and at his death to divide the said sum of £200 equally between all his children share and share alike and as to all the residue of my said monies and personal estate I give and bequeath the same unto and equally between all my other children namely Cath Coe widow Sarah the wife of Thos Clark my said son Jn Mary and Ann Drayden Bryant and my will further is that if any of my last mentioned children shall die before her his or their shares or share in any way becomes payable leaving children that such children shall take the part or share intended for her his or their parent or parents and my will and mind is and I do hereby declare that my said executors severally and respectively and their several and respective executors and administrators shall be charged and chargeable with such sums of money only as they shall respectively actually receive by virtue of the trusts hereby reposed in them notwithstanding their joining in signing any receipt or receipts or doing any other act for the sake of conformity and that they or any of them shall not be answerable or accountable for any misfortune loss or damage which may happen in the execution of the aforesaid trusts or in relation thereto except the same shall happen by or through his her or their own wilful act neglect or default and in that case each person shall b e answerable only for such loss or damage as shall arise from his own act neglect or default and also that it shall be lawful for my executors severally and respectively and their several and respective executors and administrators by and out of the monies which shall come to their hands by virtue of the trust aforesaid to deduct retain and reimburse to and for himself and themselves respectively and also to allow to each other all costs charges damages and expenses which they or any of them may sustain or incur in or about the execution of the aforesaid trusts or in relation thereto and hereby revoking all former or other wills by me at any time heretofore made I declare this to be my last will and testament in witness whereof I the said Wm Bryant have hereunto set my hand and seal the 26.4.1839 Wm Bryant signed sealed published and declared by the said Wm Bryant the testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses Jn Mayhew solicitor Coggeshall Jas Norton farmer Great Tey
