whereas at a court here held saturday being 2.4.1608 Wm Midleton took for himself and his heirs from the lord of this manor by the rod etc one parcel of customary land called Mellefielde containing by estimation 4a1r27p lying between other parcels of land parcels of Mellefield on the west and a parcel of meadow called Holmes towards the west one head thereof abutting upon Berthall Meade and the said meadow called Holmes towards the south and the other head thereof abutting upon a parcel of the said Mellefeilde towards the north as clearly shown in the said court and also whereas at a court here held saturday being 6..10.1610 the said Wm Midleton and Joan his wife at that time living took for themselves and the heirs of Wm Midleton himself another parcel parcel of Mellefielde containing by estimation 1a3r more or less lying between the said parcel of land parcel of Mellefield towards the north west and containing in length 31rod and a half and another parcel of land parcel of Mellefield now in the tenure of Jn Hodson towards the south east and containing there in length 32rod and 31rod one head thereof abutting upon a meadow called Berthall Meade towards the south west and the other head thereof abutting upon the remainder of the said parcel of land called Mellefield as also shown in the said court now at this court it is shown by the homage that the aforesaid Wm Midleton out of this court and after the last court surrendered all the aforesaid premises with their appurtenances into the hands of the lord by the hands of Jn Hamonde instead of the bailiff in the presence of Thos Smithe and Hen Abbotte (may be Hen Abbotte) two customary tenants of this manor the same testifying according to the custom of the aforesaid manor to the use and behoof of Jn Midleton and his heirs upon the conditions expressed and mentioned above and furthermore now to this court came the aforesaid Joan wife of the said Wm Midleton in person and Joan herself solely and secretly examined by the lord's steward as is the custom and surrendered into the hands of the lord by the hands of his said steward the aforesaid parcels of land parcels of Mellefield containing by estimation 1a3r of land with appurtenances to the use and behoof of the aforesaid Jn Midleton his heirs and assigns upon the following condition viz that the aforesaid Jn Midleton his heirs executors or assigns should pay or cause to be paid to the aforesaid Wm Midleton his heirs executors or assigns the sum of 36li of good and legal English money in the following manner and form viz 6li this same day being 30.5. and 10li of good and legal money upon the feast of the nativity of st jn the bapt which shall be in the 24.6.1613 at or in the now dwelling house of the said Wm Midleton situate d in Earls Colne and another 10li upon the nativity of jn bapt in 1614 in the aforesaid place and the other 10li upon the feast of the nativity of st jn bapt 24.6.1615 in the aforesaid place and also to pay or cause to be paid to the aforesaid Joan her executors or assigns the sum of 10li of good and legal money upon the feast of the nativity of st jn bapt which shall be in the year 24.6.1616 at or in the aforesaid dwelling house of the said Wm Midleton otherwise the said surrender shall be void and without force in law upon which now to this court came the aforesaid Jn Midleton and sought from the lord admittance thereof upon the aforesaid conditions to whom the lord by his aforesaid steward granted thereof seisin to have to the same said Jn Midleton and his heirs upon the aforesaid conditions to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine and made fealty and was admitted thereof tenant of the lord
fine 6li10s and afterwards sitting this present court came the aforesaid Jn Midleton and in full and open court surrendered into the hands of the lord by the hands of his aforesaid steward all and singular the aforesaid premises with appurtenances to the use and behoof of Jn Pierson and his heirs upon the following conditions viz that the aforesaid Jn Pierson his heirs executors or assigns should pay or cause to be paid to the aforesaid Jn Midleton his heir s executors or assigns the sum of 7li10s in or upon 24.6.next following after the date of this court in or at the now dwelling house of the aforesaid Jn Midleton in the aforesaid Earls Colne also he should pay to the aforesaid Wm Midleton and Joan his wife their heirs executors or assigns certain separate sums of money as above illegible text and he was admitted tenant of the lord in the aforesaid form
