whereas at a view with court here held 18.5.1630 Nich Pierce and Alice his wife Alice herself solely and secretly examined by the steward as is the custom surrendered into the hands of the lord by the hands of his steward two closes or parcels of customary land containing by estimation 4a more or less called Haynes and Clotes to the use and behoof of Sam Burton and his heirs upon condition that if the aforesaid Nich and Alice his wife or either of them the heirs executors or administrators of the said Alice should pay or cause to be paid to the aforesaid Sam Burton his executors or administrators 12li of legal money of England at or upon 9.11.1630 next following the aforesaid surrender that then the aforesaid surrender should be void and of no force as by a roll of the aforesaid court it is clearly shown and appears now at this court it is shown by the homage upon the confession of the said Nich and Alice present here in full and open court that the aforesaid Nich and Alice nor either of them paid the aforesaid Sam Burton the aforesaid 12li according to the aforesaid condition upon which the aforesaid Sam Burton present here in court humbly sought admittance to the premises with appurtenances to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have the said two closes or parcels of land called Haines and Clotes with appurtenances to the aforesaid Sam Burton his heirs and assigns forever freed from the aforesaid condition to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord fine and fealty etc
