at this court it is shown by the homage that Jn Smyth alias Bayly customary tenant of this manor after the last court and before this court viz 20.7.1631 surrendered into the hands of the lord by the hands of Jn Allyn instead of the bailiff in the presence of Edw Cressner and Jn Read two customary tenants of the aforesaid manor the same testifying according to the custom of the aforesaid manor 4a of customary land more or less called Haines and Clotes with appurtenances to the use and behoof of Dionisia Hawksby wife of Jn Hawksby clerk vicar of Earls Colne and before this wife of Rich Lancaster doctor of theology deceased for the lifetime of the said Dionisia and after her decease to the use and behoof of Mary Lancaster first born daughter of the said Rich Lancaster and Dionisia and the heirs of the body of the said Mary legitimately procreated and in default of such issue then to the use and behoof of Margt Lancaster and the heirs of the body of the said Margt legitimately procreated and in default of such issue then to the use and behoof of the rightful heirs of the said Dionisia forever upon which came here into court the aforesaid Dionisia and Mary and humbly sought admittance according to the aforesaid surrender to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have the aforesaid 4a of land with appurtenances to the aforesaid Dionisia and her assigns for her lifetime and after her decease the remainder thereof to the aforesaid Mary and the heirs of her body legitimately procreated to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord for their separate fines and the aforesaid Jn and Dionisia made fealty to the lord but the fealty of the said Mary was respited because she was under age
