whereas at a court here held 31.12.1585 Rose Rosse now wife of Edw Rosse gentleman and then wife of Robt Partridge and before wife of Jeff Cuckoe deceased was admitted tenant of the lord for herself and her heirs at the will of the lord etc to two gardens two crofts of land containing by estimation 6a called Wrongs and 2a called Coggsgrove with appurtenances by the surrender of the said Jeff Cuckoe as by a roll of the aforesaid court it is clearly shown and whereas on 11.6.1633 the aforesaid Edw Rosse and his wife surrendered into the hands of the lord by the hands of Wm Grange instead of the bailiff in the presence of Jn Church and Sam Burton two customary tenants of the aforesaid manor etc the same testifying according to the custom of the aforesaid manor the said garden crofts and other premises with appurtenances to the use of the said Rose for her lifetime and after her decease to the use of Higham Sayer esq and his heirs forever which same said surrender was shown in writing at a view with court here held 12.6.1633 as stated above and it was brought and given to the said homage of the court to present but the aforesaid surrender was not presented by the homage as sufficient at the aforesaid court for this reason both upon examination of the said Rose as is the custom and that her admission was respited now at this court the aforesaid surrender was presented and shown by the homage and furthermore was presented by the homage upon the testimony of the said Jn Church and Wm Grange that the aforesaid surrender was made well and legitimately upon which came here into court the aforesaid Rose and was solely and secretly examined by the aforesaid steward as is the custom concerning her voluntary agreement and assent to the aforesaid surrender and to the use in the aforesaid surrender and both the aforesaid Rose Rosse and the aforesaid Higham Sayer humbly sought admittance according to the aforesaid surrender to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have the aforesaid garden crofts and other premises with appurtenances to the aforesaid Rose for her lifetime the remainder thereof to the said Higham Sayer and his heirs forever to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord their separate fines and thus were admitted tenants
