and furthermore at this court it was shown by the homage that Hen Wade who held one cottage and 5a of land more or less parcel of Burtons as it is now divided which he took at a court here held 9.4.1619 after the last court viz 11.12. surrendered into the hands of the lord by the hands of Wm Adams instead of the bailiff in the presence of Wm Brewer and Jn Kent two customary tenants of the aforesaid manor the same testifying according to the custom of the aforesaid manor the aforesaid cottage and 5a of land with appurtenances by name his messuage and land in Earls Colne in which he was then living with appurtenances to the uses and intentions of his last will and afterwards he died thus seised thereof upon which came here into court Thos Wade son of the said Hen and produced here in court the testament and last will of the said Hen Wade in writing bearing the date 11.12. the tenor of which concerning the premises in these English words item I give unto Thos Wade my son and his heirs all my house and land in Earls Colne called Burtons wherein I now dwell with all and singular the appurtenances as by the aforesaid testament it plainly appears and the aforesaid Thos Wade humbly sought admittance to the aforesaid cottage and lands with appurtenances according to the tenor of the aforesaid testament to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid cottage and lands with appurtenances to the aforesaid Thos Wade his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord for a fine and made fealty and was admitted thereof tenant
