surrender in mortgage Harrison | and furthermore at this court it was testified by the aforesaid steward and shown by the homage that Thos Gill and Grace his wife after the last court viz 5.9.1639 came before the said steward and Grace herself solely and secretly examined by the steward of the court as is the custom they surrendered into the hands of the lord by the hands of the aforesaid steward all that customary cottage and garden with appurtenances called Sextons or by whatever other name it is called then or lately in the tenure of the said Thos and lying in Earls Colne to the use and behoof of Robt Harrison of Alphamstone in the county of Suffolk gentleman his heirs and assigns forever upon the condition that if the aforesaid Thos and Grace or either of them their heirs executors or assigns or any of them should pay or cause to be paid to the aforesaid Robt Harrison or his assigns the full sum of 54li of legal money of England in or upon 8.9.1640 in or at the dwelling house of the said Robt Harrison in Alphamstone aforesaid that then the aforesaid surrender should be void and of no force |
