and furthermore whereas at a court here held 1.4.1609 Dan Lea was admitted tenant of the lord for himself and his heirs to one cottage or parcel of land built upon and one piece of land containing in length 6rod and in breadth to one head 3rod and to the other head 3rod with appurtenances as by a roll of the aforesaid court it appears now at this court it is shown by the homage that the aforesaid Dan Lea after the last court viz 15.2.1640 surrendered into the hands of the lord by the hands of Wm Adams instead of the bailiff in the presence of Robt Carter and Edw Somerson two customary tenants of the aforesaid manor the said messuage with garden pertaining to the said messuage with appurtenances to the use and behoof of Dan Lea son of Robt Lea son of the said Dan Lea his heirs and assigns forever upon the condition that the aforesaid Dan Lea should allow the aforesaid Robt Lea his father to live and have a hall room and a room above the aforesaid hall room parcel of the aforesaid messuage for the lifetime of the said Robt and Mary daughter of the said Dan Lea senior should have the shop and the room above the said shop parcel of the aforesaid messuage during the lifetime of the said Mary together with free entry and exit and re-entry for the said Robt and Mary into and from the yard garden and use of the well pertaining to the said messuage and that after and before some other general court the aforesaid Dan Lea senior died upon which came here into the aforesaid court the aforesaid Dan Lea and humbly sought admittance to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid cottage with appurtenances to the aforesaid Dan Lea his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord for a fine but fealty was respited because he was under age
