at this court it was presented by the homage upon the testimony of the said steward that since the last court that is to say upon 2.4.1655 Jn Gynner and Agnes his wife Jn Algate and Jane his wife did come before the steward and the said Agnes and Jane being by the said steward solely and severally examined and consenting did surrender into the hands of the lord of the said manor by the hands of the said steward all their part and purparty of one messuage or tenement and garden with the appurtenances situate upon Colneford Hill (121) (121a) to the use and behoof of Ann Hayward of Colne Engaine spinster and of her heirs and assigns and it was further presented by the homage that since the last court that is to say upon 31.3.1655 Edith Smith Grace Smith and Eliz Smith did surrender into the hands of the lord of the said manor by the hands of Wm Adams instead of the bailiff and in the presence of Mich Hayward and Rich Fisher two customary tenants of the said manor the same witnessing all their part and purparty of the said messuage and gardens with the appurtenances to the use of the said Ann Hayward and of her heirs and assigns forever which premises the said Agnes Jane Edith Grace and Eliz did take to them and their heirs as cousins and coheirs to Thos Prior (Thos Smith) the elder deceased at a court held for the said manor 29.12.1640 and thereupon at this court the said Ann Hayward by the said Mich Hayward her attorney and deputy in that behalf did come and desired to be admitted tenant to the said messuage and garden with the appurtenances to which said Ann by the hands of her said deputy and attorney the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said messuage or tenement and garden with the appurtenances to the said Ann Hayward her heirs and assigns of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due and she gave to the lord for a fine
