Rose Abbott to Lythards also Newmans and Glasiers to this court came Edw Hewson gentleman and Eliz his wife daughter and heir of Jn Lucas gentleman and Mary his wife deceased and late wife of Thos Ball senior deceased and the aforesaid Eliz by the aforesaid steward first solely and secretly examined as is the custom and consenting the aforesaid Edw and Eliz by the rod surrendered into the hands of the lord by the hands of his aforesaid steward one close of pasture containing by estimation 8a more or less called Lythards also Newmans and one parcel of land called Glasiers containing by estimation 2a more or less with appurtenances which premises the aforesaid Eliz first took at this court after a recovery thereof among others for herself and her heirs to the use and behoof of Rose Abbott elder daughter of Hen Abbott of Earls Colne saymaker and the heirs and assigns of the said Rose forever upon the good faith and trust however that if the aforesaid Hen outlives Rose now his wife and the mother of the said Rose and if the aforesaid Rose wife of the aforesaid Hen should die without heirs of her body procreated by the said Hen that from then the heirs of the said Rose the daughter should surrender the premises according to the custom of the aforesaid manor to the use and behoof of the said Hen his heirs and assigns forever upon which came here into court the aforesaid Rose by the said Hen in the part of her attorney and deputy and sought admittance as tenant of the lord for the premises to whom the same said Rose by the hands of her attorney and deputy the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid close of pasture called Lithards also Newmans and the aforesaid parcel of land called Glasiers with appurtenances to the aforesaid Rose the daughter her heirs and assigns forever upon the aforesaid trust and good faith from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the separate rents services and customs thereunto belonging and by right accustomed and she gave to the lord for a fine
