at a court held 15.6.15Chas2 Sam Burton and Frances his wife were admitted to them and the heirs of the said Sam on the body of the said Frances legitimately procreated to remain to the right heirs of the said Sam to one messuage or tenement and garden with appurtenances then late Wm Waite's now at this court it appeared that the said Sam died before this court and that the said Frances survived him and that Sam Burton is their only son and heir upon which came the said Frances Burton widow and the said Sam Burton the son and Eliz his wife and the said Eliz solely examined and consenting surrendered the said messuage to the use of Thos Polley and his heirs and assigns forever who present was admitted etc and gave fine and after the admittance came Jn Hutchinson and complained against the said Thos Polley in a plea of land viz of one messuage and one garden with appurtenances in Earls Colne etc and Thos brought the said Sam Burton and Eliz his wife to warrant who brought Mortlock Coldham gentleman to warrant and the said Jn Hutchinson recovered against Mortlock Coldham and seisin was delivered to him by Jonathan Grimwood bailiff of the manor etc and he was admitted etc and fine was pardoned and after the said admittance the said Jn Hutchinson and Thos Polley surrendered the said messuage or tenement and garden to the use of the said Frances Burton and assigns for life and after her decease to the use of the said Sam Burton and Eliz his wife and the heirs of the said Sam forever which Frances Sam and Eliz were admitted etc and gave fine
