also at this court found that on 10.1.last Eliz Burton widow and Sam Burton her son surrendered by the hands of Hen Burton instead of the bailiff in the presence of Jn Harrington and Sam Smith all that their messuage or tenement outhouses and garden with appurtenances formerly of Wm Wait in Earls Colne and now in the occupation of the said Eliz Burton or her assigns and the reversion etc to the use of Rich Wale of Earls Colne gentleman upon condition that if the said Eliz Burton and Sam Burton or either of them or the heirs or administrators of the said Sam Burton should pay Rich Wale his executors etc the sum of 47li3s 11.7.next then the surrender void etc
