it is shown as mentioned above by the homage that Wm Fawcett before this court and after the last court surrendered into the hands of the lord by the hands of Jn Reade instead of the bailiff in the presence of Barth Clarke and Jn Clarke two customary tenants of the lord the same testifying according to the custom of the said manor one customary tenement with appurtenances in the said Colne late of Jn Haie and now in the tenure or occupation of Jn Clarke which certain tenement with appurtenances the aforesaid Wm Fawcett took for himself and his heirs by a surrender of Robt Warren at a view with court here held monday being 20.6.1603 as by copy of a roll of the said court is clearly shown to the use and behoof of Wm Fawcett son of the said Wm and the heirs of the body of the aforesaid Wm the son legitimately procreated and in default of such heirs the remainder thereof to Xoph Fawcett one of the other sons of the aforesaid Wm the father and the heirs and assigns of the aforesaid Xoph forever to whom the same Wm Fawcett the son present here in court the lord by his steward granted and delivered seisin thereof by the rod to have for himself and the heirs of his body legitimately procreated the remainder thereof in default of such heirs to the aforesaid Xoph his heirs and assigns forever to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents customs and services thereunto belonging and by right accustomed and the aforesaid Wm the son made fealty to the lord and paid the fine and was admitted in the said form tenant of the lord
