surrender in mortgageit is shown by the homage that Edw Browne customary tenant of this manor out of court namely 4.6.last past surrendered into the hands of the lord by the hands of Sam Cosyn instead of the bailiff in the presence of Barth Clarke and Jn Clarke two customary tenants of this manor the same witnessing according to the custom of the said manor one cottage with a certain place called a forge and one garden adjoining the same called Charles Paine situated in Earls Colne between the churchyard of the parish church of the said Colne on the one side towards the north and a way leading towards Colne Park on the other side towards the south one head thereof abutting upon Church Green towards the east and the other head thereof abutting upon Hall Yard held of the said manor by copy of court roll to the use and behoof of Jn Betts his heirs and assigns upon condition however that if the aforesaid Edw Browne his heirs executors administrators or assigns should pay or cause to be paid to the aforesaid Jn Betts his executors administrator or assigns the full sum of 14li in or upon 4.6.next following upon the date of this surrender that then this present surrender should be void and have no force in law otherwise it should stand in full force and effect
