whereas at a view with court here held 5.10.1612 Hen Byrd was admitted tenant for himself and his heirs by and after the death of Hen Byrd his father as the son and next heir of the said Hen to one croft of land called Wallnuttree Croft as by a court roll here in court lawfully and fully produced and shown now at this court it is shown by the homage that the said Hen Byrd before this court died without heirs of his body and that the same said Rich Byrd was his brother and next heir of the said Hen the son who the same said Rich after the last court and before this court similarly died and before his death viz on 8.1.last past surrendered into the hands of the lord by the hands of Rich Kempe and Thos Pryor two customary tenants of the manor of Earls Colne and Colne Priory in the presence of Peter Mott instead of the bailiff the said croft of land called Wallnuttree Croft in the said Earls Colne then in the tenure of Rich Kempe and all other lands and customary tenements which came to the said Rich as next heir by and after the death of the said Hen to hold from the lord of the said manor then in the occupation of mr Cosen gentleman Rich Kempe Jn Bridge or any of them in the said Earls Colne to the use of the last will of the said Rich the tenor of which in the following words item I give unto Jn Lucas of Salcot Wigborrowe and to Mary his wife my nearest younger sister and to the longer liver of them both all my customary lands and tenements lying in the parish of Earls Colne and now in the occupation of Wm Cosen Rich Kempe and Jn Bridge during the time of their natural lives and after their decease to Mary Lucas the elder daughter of the said Jn and Mary Lucas my sister and to her heirs forever as by a copy of the said will here produced and shown in court bearing the date 8.1.last past clearly shown and appears who the same said Jn Lucas and Mary his wife present here in court sought admittance to the said premises according to the surrender and the said last will to whom the same said Jn and Mary his wife the lord by his said steward granted seisin thereof to have to the said Jn and Mary his wife for their lifetimes according to the said surrender and the said last will by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord their fine as etc in the margin     and the said Jn made fealty to the lord and they were admitted thereof tenants
