at this court it is shown by the homage that Thos Pryor customary tenant of this manor after the last court and before this court viz 28.11.1628 surrendered into the hands of the lord by the hands of Wm Adams instead of the bailiff in the presence of Robt Rookes and Jn Smyth two customary tenants of the said manor the same testifying according to the custom of the said manor all that his messuage with all and singular appurtenances situated and being in the street of Earls Colne and where the said Thos then lived to the use and behoof of Barth Clark his heirs and assigns upon condition that if the aforesaid Thos Prior his heirs executors or assigns should pay or cause to be paid to the said Barth Clarke his heirs executors administrators or assigns 5li8s at the feast of st andrew the apostle that should be in the year 30.11.1629 that then the said surrender should be void and of no force
