a parcel of Swinesty | and furthermore whereas at a court here held 20.10.1646 it was shown by the then homage of the court that Jas Burton surrendered into the hands of the lord by the hands of Xoph Buers instead of the bailiff and in the presence of Jn Reade and Hen Coney two customary tenants of the said manor testifying one messuage divided into three dwelling places to the use and intention of his last will and testament and that through the testament and his last will in writing bearing the date 4.1.1642 he gave and bequeathed all that part of the said messuage then in the tenure and occupation of Wm Warde containing one lower room and one upper room to Sarah Burton his daughter and her heirs forever and afterwards he died seised thereof as is shown by the said court roll now to this court came the said Sarah now wife of Thos Ballard and humbly sought admittance to the said part of the said messuage to whom the lord by the said steward granted and delivered seisin by the rod to have and to hold the said part of the said messuage containing one lower room and one upper room with appurtenances to the said Sarah and her heirs from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and she paid her fine and made fealty |
