and further it was presented by the homage that Hen Cony who held to himself and his heirs one cottage with the appurtenances called Cookes otherwise Copes with a way to a well late in the tenure of Abraham Pike upon 17.1.1650 did surrender into the hands of the lord by the hands of Mich Hayward in place of the lord's bailiff and in the presence of Ambrose Waller and Wm Adams the elder two customary tenants of the said manor the said cottage and premises with the appurtenances to the use of Jn Hayward son of Simon Hayward and of the heirs and assigns of the said Jn forever upon condition that if the said Hen Cony his heirs executors administrators or assigns well and truly pay or cause to be paid to the said Jn Hayward his heirs or assigns or administrators the sum of 9li12s of lawful English money upon 24.1.1651 at the then dwelling house of the said Simon Hayward situate in Colne Engaine that then the surrender should be void now at this court the said Jn Hayward by Mich Hayward his attorney and deputy came and informed the court that the said sum of 9li12s or any part thereof was not paid according to the condition of the said surrender and yet is unpaid and thereupon humbly prayed to be admitted to the premises to which the said Jn Hayward by the hand of the said Mich his deputy the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said cottage and premises with the appurtenances to the said Jn Hayward his heirs and assigns of the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services due and accustomed and he gave to the lord for a fine but his fealty is respited
