whereas at a court held for the said manor 11.6.1633 Edw Potter took for himself and his heirs by copy of court roll one cottage and parcel of land late of a waste field of the said manor situated upon Colne Greene by the surrender of Jeremy Cooke and Ann Cooke now at this court it was shown by the homage that the said Edw after the last court viz 6.3.1668 surrendered into the hands of the lord by the hands of Robt Nicoll instead of the bailiff and in the presence of Jn Pennocke and Jn Finch two customary tenants of the said manor the same testifying etc the said premises amo ng others by name all that his lands and customary tenements held of the said manor to the wishes and uses declared or to be declared in his testament and last will and afterwards he died seised thereof upon which came here into court Geo Potter one of the sons of the said Edw and showed here in court the testament and last will of the said Edw in writing bearing date 6.3.1668 as said above the tenor of which said testament concerning the premises in the following English words item I do hereby give and bequeath unto my son Geo Potter one other tenement which I purchased of one Cooke to remain to him and his heirs as is shown by the said testament proved 3.11.1668 before the secretary of the office of record at Colchester and upon this the said Geo sought admittance for himself as tenant of the lord for the premises to whom the lord by the said steward granted and delivered seisin thereof by the rod to have and to hold the said cottage and parcel of land with appurtenances to the said Geo his heirs and assigns forever from the lord by the rod at the will of the lord at the will of the lord according to the custom of the said manor by the rents services thereunto belonging and by right accustomed and he gave to the lord his fine etc
