whereas at a court held for the said manor 3.1.1638 Edw Potter was admitted tenant of the lord for himself and his heirs to one tenement called Mordens also Crossend with yards gardens and orchards and the pump thereof with appurtenances pertaining to the said tenement one (sic) with the backhouse kiln and kilnhouse parcel of Joldens with yards and gardens and appurtenances except for all rights and privilege then before surrendered to the use of Barth Clarke and his heirs which premises the said Edw took by the surrender of Rich Rookes now at this court it was shown by the homage that the said Edw after the last court viz 6.3.1668 surrendered into the hands of the lord by the hands of Robt Nicoll instead of the bailiff and in the presence of Jn Pennocke and Jn Finch two customary tenants of the said manor the same testifying etc the said premises among others by name all his lands and customary tenements held of the said manor to the wishes and uses declared or to be declared in the testament and last will of the said Edw and that afterwards and before this court he died thus seised thereof now to this court came Geo Potter one of the sons of the said Edw and showed here in court the testament and last will of the said Edw here in writing bearing the date 6.3.1668 the tenor of which testament concerning the premises in the following English words item I do hereby give and bequeath unto my son Geo Potter certain customary or copyhold tenements which I purchased of Edw Rookes (sic) wherein Geo Peartree and Geo Mann now live lying in Earls Colne aforesaid all which to remain to him and his heirs forever as is shown by the said testament proved before the secretary for the office of record for Colchester 3.11.1668 and upon this the said Geo Potter sought admittance for himself as tenant of the lord for the premises to whom the lord by the said steward granted and delivered seisin thereof by the rod to have and to hold the said tenement with all other premises with appurtenances to the said Geo Potter his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord his fine etc
