at a court held 4.4.1671 Robt Payne alias Allen was admitted to a cottage late into two divided once parcel of Windmill Hill with all appurtenances then in the tenure of Ellen Smith widow and Eliz Ellis widow and after in the several occupations of Jas Allen and the said Robt Payne now appears that he surrendered on 14.3.1680 by the hands of Sam Burton instead of the bailiff in the presence of Jn Garrett and Jn Fletcher two customary tenants etc all his customary lands held of the manor to the use of his last will and that he has since died upon which came Grace Payne alias Allen late his wife and showed the will dated 15.3.1680 the words concerning the premises as follows item I give and bequeath unto Grace Payne my said wife during the term of her life all that my messuage or tenement with the appurtenances now in the occupation of Jas Allen lying in Earls Colne aforesaid and after her decease I give the same unto Grace Payne my youngest daughter and to the heirs of her body lawfully begotten and their heirs forever but if the said Grace Payne my daughter shall happen to die without any issue as aforesaid and that Grace Payne my wife should survive the said Grace my daughter then I give the said tenement and appurtenances to the said Grace my wife her heirs and assigns forever and Grace Payne alias Allen is admitted to the premises for her life and gave the fine and fealty respited
