fine 10s condition and to this court came Wm Kyrwyn and Christine his wife who herself by the steward of the lord solely and secretly examined and Thos Gurnay and Wm Bom and surrendered into the hands of the lord by the hands of Jn Smyth the lord's tenant in the absence of the bailiff in the presence of Ralph Audele and others the same testifying two cottages with their appurtenances which were sometime of Wm Atte Wode and afterwards of Jn Atte Wood to the use of Jeff Bukwell Joan his wife Jn William Wm Nobele vicar of Colne Rich Rothe of Pebmarsh to whom it is granted thereof seisin to hold to the same said Jeff Joan his wife Jn William Wm Nobele and Rich Rothe and the ir assigns from the lord by the rod at the will of the lord and according to the custom of the manor by the ancient services and customs etc and upon the condition that the aforesaid Jeff or his attorney by name should pay or cause to be paid to the aforesaid Wm Kyrwyn 11li6s8d sterling viz at the feast of michaelmas then next following after one whole year after the date of this court 40s and at any feast of michaelmas then next immediately following agreed payments and in the last year of his payment 26s8d thus that at the aforesaid feast the said sum of 11li6s8d should be truly paid as aforesaid that then this surrender should stand in full force and effect and if the aforesaid Jeff Bukwell and his attorney should default in any payment or aforesaid payments which ought to be paid in part or in whole at any day of the aforesaid feasts that then it should be allowed to the aforesaid Wm Kyrwyn and his cofeoffees into the said two cottages with their appurtenances by default of the aforesaid payments thereof to reenter and to rehold them and in their former estate by licence of the court to have and to enjoy notwithstanding the previous surrender made thereof which should be now and saving the rights etc and for having such estate thereof the aforesaid Jeff and his cofeoffees gave to the lord for a fine as shown in the margin etc and made fealty to the lord etc
