Copes Xfine     to this court came Wm Swattock and surrendered into the lord's hands one tenement with a curtilage and the appurtenances sometime called Copes and lies between the messuage sometime Steph Miller of the one part and Jn Wright's garden of the other part one head thereof abutting upon the way toward Colchester as by the metes and bounds etc and also one parcel of land of the waste lying at Colfordhill upon which the same Wm Swattock of new hath builded a swinesty and contains in length 14ft and in breadth 12ft6i as by the metes and bounds etc to the intent that the lord thereof so seised might regrant the same cottage with the curtilage called Copes and the foresaid parcel of land to the foresaid Wm Swattock and Joan his wife to hold to them and their assigns during the term of their lives and the longer liver of them of the lord by the rod etc to remain after their decease and the longer liver of them to Agnes Bauldwyn singlewoman and her heirs on condition following viz that if the foresaid Agnes Bauldwyn her heirs or assigns pay or cause to be paid to the foresaid Wm Swattock and Joan his wife yearly during the whole term of their lives and the longer liver of them in the parish church of Earls Colne aforesaid 40s sterling at four term of the year namely at the feast of the nativity of st john baptist st michael the archangel the birth of our lord the annunciation of blessed marie the virgin by equal portions to be paid that then this present surrender and seisin thereof delivered shall remain and stand in all his strength and effect and if their be default in any payment of the payments aforesaid contrary to the form aforesaid that then this present surrender and seisin thereof delivered shall be void and of none effect and the lord by virtue of the surrender aforesaid in the foresaid cottage with the curtilage and the appurtenances so seised at this present court by his steward regranted out of his hands the said cottage with the curtilage and the appurtenances to the foresaid Wm Swattock and Joan his wife to hold to them and their assigns during the terms of their lives and the longer liver of them of the lord by the rod etc to remain after their decease and the longer liver of them to the foresaid Agnes Baldwyne and her assigns on condition above written to which Wm Swattock and Joan by the lord's steward there is seisin thereof delivered to hold to them and their assigns during the whole term of their lives and the longer liver of them of the lord etc to remain after their decease and the longer liver of them to the foresaid Agnes Baldwyn and her heirs on condition above written and the foresaid Wm and Joan give fine etc and made fealty
