at which day at Earls Colne aforesaid viz to this court came as well the foresaid Roger Booner in his proper person as the said Wm Estaie and Lewis Jegon bailiff of the manor aforesaid and minister of this court and here returned a certain precept to him directed at the last court served and executed in all points and hereupon the jurors impanneled viz Robt Greene Jn Mallary Jn Leffingwell Geo Bieston Jn Pennock Jn Game Hen Pullen Jn Tillwick Nich Garrard Jn Farthing Hen Prentice Wm Finche Jn Ruffle Clem Sparrowe Wm Olmested and Jn Chatterton came likewise who being chosen and sworn to speak the the truth concerning the premises say upon their oath that the foresaid Roger hath more right to have the foresaid garden with the appurtenances as he before craved the same then the foresaid Wm hath to hold the same garden with the appurtenances as he now holdeth the same etc therefore it is considered by the court that the said Roger recover his seisin against the said Wm of the foresaid garden with the appurtenances to hold to the same Roger and his heirs quietly from the said Wm and his heirs forever etc and the same Wm in the lord's mercy etc and hereupon the said Roger to be admitted to the foresaid garden with the appurtenances according to the form of the recovery aforesaid whereupon at this court the lord by his steward granted to the foresaid garden with the appurtenances to have and to hold to him and his heirs quietly from the foresaid Wm and his heirs forever according to the form of the recovery aforesaid of the lord by the rod according to the custom of the manor aforesaid by the rents and services thereof due and of right accustomed and he giveth fine for such estate and entry thereunto to be had and made fealty
