fine 2s6d Brayes | to this court came Martin Borrowe and Joan his wife and the same Joan alone and secretly examined by the lord's steward surrendered into the lord's hands one tenement or cottage with appurtenances called Brayes in Colne aforesaid as by the meets and bounds etc to the use and behoof of Wm Smithe his heirs and assigns etc who being present in court came and prayed to be admitted thereunto and he is admitted the lord's tenant thereof to whom by the lord's steward there is seisin thereof delivered to hold to him his heirs and assigns of the lord by the rod to the will of the lord according to the custom of the manor by the rents and services therefore before due and of right accustomed and he giveth fine etc and made fealty yet this present surrender and seisin thereof delivered is made on condition following viz that if the foresaid Wm Smithe his heirs or assigns pay of cause to be paid to the foresaid Martin Borrowe or his certain attorney or executor 7li6s8d of good and lawful money of Engla nd in manner and form following viz on tuesday in the week of pentecost next after the date of this court in the mansion house of Lewice Jegon in Colne aforesaid 3li13s4d and on tuesday in the week of pentecost then next following 3li13s4d in the place aforesaid in full payment and satisfaction of the said 7li6s8d that then this present surrender and seisin thereof delivered shall stand remain and be in his full force and effect and if there be any default in any payment of the payments aforesaid contrary to the form aforesaid that then it shall be lawful to the foresaid Martin Borrowe and his heirs into the foresaid tenement or cottage and every parcel thereof called Brayes to reenter and the same as in his or their former estate to have again repossess and enjoy as in his or their former estate and the foresaid Wm Smithe his heirs and assigns from thence wholly to expel and remove this present surrender or anything therein contained to the contrary thereof in anywise notwithstanding |
