whereas at a view with court here held on saturday in the week of pentecost 36Eliz1 25.5.1594 Robt Knight was admitted tenant to himself and his heirs by the surrender of Edm Potter to one piece of land containing by estimation 1a more or less late parcel of a croft of land called Bearcroft lying in Colne aforesaid viz between land late of Thos Christmas and after of Barth Church on the east part and the land now of Hen Smith residue of a croft of land called Bearcroft on the other part to the west one head thereof abuts on a way leading to the parish church of Earls Colne aforesaid from Colne Park to the south and the other head abuts on a garden late Rich Holborough against the north as shown by copy of court roll and also at a view with court here held saturday 9.6.35Eliz1 Robt Knight was admitted tenant to himself and his heirs of the surrender of Hen Smith to one croft of land enclosed containing by estimation in all 3a3r of land parcel of a croft called Bearcroft lying between lands of Robt Allen called Be arcroft on the one part to the west and lands of Lewis Jegon late parcel of the said croft called Bearcroft on the other part to the east one head thereof abuts on a way called Bearcroft Lane to the south as appears in the roll of the court now at this court it appears to the homage aforesaid that after the last court and before this court the aforesaid Robt Knight died and that before his death he surrendered all and singular the premises with appurtenances into the hands of the lord by the hands of Robt Cobbe instead of the bailiff in the presence of Francis Newton and Jn Pierson two customary tenants of the manor witnessing according to the custom of the manor aforesaid to the use and work of his last will and testament which will is here shown concer ning the land in the following words viz item I give unto Constance my loving wife all that my customary croft of land called Bearcroft holden of the manor of Earls Colne aforesaid to have and to hold unto her and her assigns until Robt Knight my son shall come to the age of 22years then to remain to the said Robt and to the heirs of his body lawfully begotten forever provided nevertheless that if my said son Robt Knight shall die before he come to his age of 22years then the said croft of land called Bearcroft shall remain to Jn Knight my son upon condition that he pay unto Wm Knight one other of my sons the sum of 20li within four years next after the said Jn Knight shall enjoy and receive any benefit of the said croft of land provided nevertheless that if the said Jn Knight shall refuse or make default in payment of the said sum of 20li at the time before limited then I will that the said croft of land shall remain unto my said son Wm Knight and his heirs forever upon condition that the said Wm Knight pay or cause to be paid unto the said Jn Knight the sum of 20li within four years next after he the said Wm Knight shall receive and enjoy the benefit of the said croft of land as in the said will and testament is shown which Constance and Robt present here in court are granted seisin of the premises according to the form of the will of the lord by the rod at the will of the lord according to the custom of the manor aforesaid by the rents services and customs before due and of right accustomed and they made their several fines and were admitted thereof tenants
