whereas at a view with court here held on wednesday in the week of easter 19.4.40Eliz1 it was presented by the homage of the court that before that court Rich Haywood surrendered into the hands of the lord by the hands of Jn Church instead of the bailiff in the presence of Jn Church and Robt Reade two customary tenants of the manor according to the custom of the manor aforesaid the east end of a certain customary tenement called Masons containing in length 37f viz to a yard with a stable barn and garden lying on the north and east end of the said tenement parcel of a messuage with appurtenances called Masons lying between the churchyard of the parish church of Earls Colne aforesaid and the road leading from Colne aforesaid to Halstead on the north part to the work and use of Jas Haywood and his heirs who did not come to court to take the premises out of the hands of the lord and to satisfy the fine therefore they ordered the bailiff of the manor aforesaid to seize the premises as is shown by the roll of the court now it appears to the homage aforesaid that the aforesaid Jas Haywood before his a dmission died seised of the premises and that Rich Haywood is his brother and next heir of the said Jas who present here in the court asked to be admitted to hold the premises of the lord etc which Rich is granted seisin to have to himself and his heirs to hold of the lord by the rod at the will of the lord according to the custom of the manor aforesaid by the rents services and customs before due and of right accustomed and he made fine and was admitted and afterwards came the aforesaid Rich Haywood and in open court surrendered into the hands of the lord by the hands of the steward all and singular the premises with appurtenances to the use and work of Rachel Haywood his sister and her heirs which Rachel present here in the court was granted seisin to have to herself and her heirs to hold of the lord by the rod at the will of the lord according to the custom of the manor aforesaid by the rents services and customs before due and of right accustomed and made fine and fealty and was admitted tenant
